Which foreigners do not need a work permit to work in France?

As a reminder, a work permit is an official document issued by the French administration, allowing a foreigner to work legally in France. It is necessary for employers wishing to recruit non-EU workers, in order to ensure that they comply with the legal conditions for carrying out a professional activity on French territory.

This authorization is issued by the prefecture or the Regional Directorate of Enterprises, Competition, Consumption, Labour and Employment (DIRECCTE) after the employer has made the request. The employer must also provide supporting documents regarding the proposed job and prove that the position could not be filled by a local employee.

The following categories are exempt from obtaining a work permit:

  • Nationals of the countries of the European Union (EU), the European Economic Area (EEA) and Switzerland
  • Family members of a European citizen (spouses, minor children, etc.)
  • Holders of a 10-year resident card
  • Holders of a residence card «private and family life» for Algerian nationals
  • Holders of the “Talent – Family Companion” residence card

It is important to note that a holder of residence permit from another European country (not French) cannot work in France. Free movement of workers applies only to nationals of European countries.
